Dangerous Dog can move from living with owners to living with a registered keeper (Pam Rose)

R (Sandhu) v Isleworth Crown Court

Admin Court

A ruling by the High Court last week states that pit bull type dogs that are unable to live with their legal owners can instead live with a registered keeper.

This means that Bullet and Cuddles, who have been in kennels for just under 2 years can now live with a registered keeper (as the owner is in prison on other matters).

The High Court ruled that this does NOT amount to making a gift or transfer of ownership.
Hopefully this case and the one below will clarify the law and save many dogs from unecessary destruction.

This argument on law has been a long time coming. It was successfully argued with the CCRC (2005) and they referred a case to Blackfriars Crown Court (2007) who then permitted the dog the live with keepers but DEFRA were not content.

 R v Canterbury Crown Court  2012 (Admin)

Please note that if someone is charged under s. 3 of the dangerous dogs act, and the court is not satisfied with the dog remaining with the owner, the court has powers to order the dog live elsewhere.

This case clarifies R v Natasha Devon.
