Richard acts for applicants in homeless appeals and judicial reviews, including emergency applications and those under s.17 of the Children Act 1989, and unlawful/wrongful evictions. He appears in cases involving defending possession proceedings on grounds of rent arrears, nuisance, anti-social behaviour (including injunctions), disrepair actions and counterclaims. He is particularly fond of arguments involving estoppel, construction of contract (including unfair contract terms), capacity and the Disability Discrimination Act 1995.
Richard has experience of a wide range of Public Law including Judicial Review in Community Care, Crown Court Bail, Immigration, Mental Health and Professional Regulatory Bodies. He also has experience of applications for Habeas Corpus. He is available to advise prospective applicants in Public Law matters on an urgent basis if required.
Richard retains a practice in Bankruptcy, Ancillary Relief and other property disputes, particularly those involving trusts matters and questions as to undue influence.
At the beginning of his career at the Bar Richard practised in a wide range of areas before eventually specialising in Housing, Public law and Property. This allows him to see his current specialisms in the wider context, providing clients with a holistic service advising and making referrals for advice and assistance on benefits, special educational needs, drug and alcohol dependency, immigration and community care. He also has experience of practice in foreign jurisdictions enabling him to approach problems from different perspectives.
